THE Government is still making payments to the Dutch firm which developed the now-mothballed electronic voting machines that were bought by the State
writes Senan Molony.(Irish Independent) Powervote (Ireland) has been liquidated by its parent, NEDAP Powervote - the company that came up with the electronic voting machines.!!
They were condemned by a specially-formed Commission on Electronic Voting three years ago, and yesterday it was claimed the machines used old technology. 
Some 6,000 machines remain in storage around Ireland, at a continuing annual storage cost of around €1m, even though they cannot be used without new software being developed.
The Exchequer has been paying royalty and service contract amounts to Powervote, despite the machines being written off for the impending general election and the 2004 local and European elections. The Department of the Environment said last night that payments would continue to be paid to the Dutch parent.

The feisty widow of the late Liam Lawlor TD has secured leave in the High Court to bring an action aimed at preventing the Mahon planning tribunal from making any findings of "serious misconduct" against herself or her husband unless it can prove those beyond reasonable doubt.
Ms Hazel Lawlor said the tribunal had "destroyed the life of her husband, herself and their family" and had displayed a "vindictive and vengeful" attitude towards her husband. She was in personal fear of the powers of the tribunal and how they might be used against her, she added.
But why would she be fearful, if she has nothing to hide.?
Jan 2007,Mr Martin Giblin SC for Ms Lawlor, of Somerton House, Lucan, Co Dublin got leave from Mr Justice Michael Peart to bring judicial review proceedings against the tribunal in which she is seeking a number of orders and declarations including an injunction, pending further court order, restraining further inquiries by the tribunal into matters concerning her.
She is also seeking several declarations, including that the tribunal may not make findings of serious misconduct against her late husband, who died in a car crash in Moscow in October 2005, or against herself, unless supported by evidence proven beyond any reasonable doubt, not on the basis of balance of probabilities.
Shure on this basis, Charles Haughey, Ray Burke, and every other gangster in the Fianna Fail Party is, like Richard Kimble, an innocent , hunted victim ,of blind justice.?
In an affidavit, Ms Lawlor, (a mother of four strapping,highly successful, american based sons,) said no findings as such were made against her late husband by the Tribunal as no module in which he was involved was brought to a conclusion by the time of his death. He had found the tribunal proceedings to be interminable (that we can believe
)and the failure to start and finish lines of enquiry was a matter of great frustration, confusion and exhaustion to him.
(Particularly during the various spells he spent in jail for obstructing the Tribunal and burning his incriminating papers in a back garden bonfire witnessed by neighbours

She and their children felt the tribunal proceedings were never going to end. (Lucky for the lawyers anyway

She said,there was an "oppressive degree of attention" focused on her late husband.(Not really, I believe Burke, Haughey, Flynn, and others compete for that award)and although he had "made every effort to supply the information",(sic) he was nonetheless found to be in contempt. Many of the documents sought were material but her husband was not legally obliged to retain them and many were of great antiquity.

Ms Lawlor said her husband was fearful that findings would be made against him without adequate proof and without a proper opportunity to challenge his accusers. (Haughey wont be back to do that either,- thank heavens!)
"I and my family continue to share that fear. The time spent on Tribunal business and the enormous pressure put on my late husband had a dreadful effect on him on me and on our children. The Tribunal ruined our lives in a way which would not have occurred if my late husband had legal representation".(?)
Mr Lawlor, she added, was the "victim of some appalling publicity which was factually incorrect, factually distorted and libelous". The Tribunal, as far as she could ascertain, did not lift a finger to protect her husband or her family from damaging leaks.
The treatment of Mr Frank Dunlop by the Tribunal was "in stark contrast" to that meted out to Liam Lawlor, she said.
Yes but Frank came out with his hands up, Mrs Lawlor. now you and your fine sons would do the state some service if ye did the same,and did it now. It might even prevent the tragedy of his associates, and fellow strokers in Fianna Fail being returned to misgovern this nation for another five long interminable years.
Now that would be a real legacy for the Lawlor family to leave to the nation.

February 2007: THE 'Sunday World' newspaper failed in its bid to have Ukrainian woman Julia Kushnir, who is suing the newspaper for libel, lodge a sum of €30,000 in court as security towards costs if her case fails.
Ms Kushnir survived the car crash in Moscow in which former Fianna Fail TD Liam Lawlor died in October 2005.
A translator, Ms Kushnir has sued a number of newspapers as a result of the reporting of the crash. The first case, alleging libel against the 'Sunday World', will begin in the High Court on February 21.
Ms Kushnir has claimed that she was libelled when it was wrongly suggested that Mr Lawlor was in the company of a teenage prostitute at the time of the accident.
She is to travel to Ireland for the hearing, along with character witnesses from Tel Aviv, New York and Moscow. 
Turning down the newspaper's application yesterday, Mr Justice Michael Hanna said it was breathtaking that the 'Sunday World' should wait until now to make the application. (does not say much for the newspapers lawyers..

He said it could have been made months ago.
Earier, counsel for the 'Sunday World', John Gordon, in applying to secure costs against Ms Kushnir, said she had brought proceedings relating to an article which appeared in the Dublin edition of the newspaper on the tragic death of Liam Lawlor.
The article did not name Ms Kushnir and the story did not appear in all editions of the 'Sunday World', he said. The newspaper's solicitors had written to Ms Kushnir's side on January 18 last, seeking security in the event she did not succeed in her action.
The result, he said, was an extraordinary letter in which Ms Kushnir's side asked if they had been spying after they made the statement in a letter to the Kushnir side that the translator had no assets within the EU. 
Counsel said that the full costs of the Kushnir case would be in the region of €90,000, allowing for a three-day trial. Ms Kushnir, he said, was not an EU citizen despite living in Prague for the last 15 years.
The mere fact of her being a resident of Prague did not exempt her from providing security. For reasons of her own Ms Kushnir, counsel said, chose not to give the court information that might be helpful. Counsel for Ms Kushnir, Paul O'Higgins, said Mr Gordon had cast the case as if Ms Kushnir in some arrogant fashion had failed to answer questions.
Mr O'Higgins said a question was never asked about assets and this application had been made when all the costs in the case had been incurred. He contended it would be inappropriate to grant the order.

"Hospital van linked to dumping of homeless paraplegic.
A LOS Angeles hospital van has been linked with the dumping of a paraplegic man in Skid Row, the city’s large homeless area, where he was left crawling in the street with nothing more than a soiled gown and a broken colostomy bag, police said.
Witnesses wrote down a phone number printed on the van and took down its licence plate number, which helped detectives connect the vehicle to Hollywood Presbyterian Medical Centre, the Los Angeles Times reported.

According to newspaper reports on the Moriarty findings, C.J. Haughey is to avoid serious censure, as there is no proof of "corruption" We beg to differ.
The Moriarty Tribunal, have indicated that Charles Haughey,s "lifestyle" funds came from well-known businessmen, friends of the former Taoiseach, such as Michael Smurfit, Dermot Desmond, PV Doyle, Ed Farrell, John Byrne, Mark Kavanagh, Larry Goodman and Patrick Gallagher, and so on.
Mr Haughey had told the tribunal that he saw nothing wrong with a "political person" receiving support from institutions or individuals who admired what a politician was doing and gave the money for "absolutely disinvolved purposes".
In relation to money, amounting to several million pounds, which was raised by Mr Traynor on behalf of Mr Haughey,- the tribunal, as anticipated, found no evidence of "corruption", we are told.
The good citizens of Ireland who " paid as they earned" virtually the totality of income taxes which maintained the dismal public services of the nation for the past three decades, have the evidence however that Charles Haughey,s handlers knowingly and willingly supervised a regime of widespread tax evasion by numerous self employed businessmen, and professional people. In many instances, some of them used the same offshore banking facilities as himself.
He not only knew this, but acquiesced fully in its perpetuation , by leaving the revenue gathering arm of the public service, understaffed ,underfunded, and toothless for all of his lifetime,until the rumours of widespread political corruption were screaming from the treetops, which our present Taoiseach was climbing diligently, while failed to observe the abundance of bad apples before his very eyes.!
Haugheys efforts to extract even a token contribution from the farming community decades ago, when he proposed a small V.A. T. charge, on agricultural produce was the nearest he ever got to tapping the self employed, in order to inject some equality into the P.A.Y.E. earners ongoing crucifiction. The uproar from this cosseted class, whose tractors blocked Merrion square at the time, resulted in an ignominous backdown for Haughey.
The Italian Mafia, "Cosa Nostra" operated by offered "protection" to wealthy landowners and businessmen etc in return for "donations" to the cause.The "Friends of Fianna Fail" received awesome protection in a similiar way from the unwelcome intrusions of the Revenue Commissioners.To cap the Sicilian Corleones, the irish political Mafia (Fianna Fail) were also running their benefactors offshore bank.! Today banking headquarters has moved to Ballybrit. Little else has changed.
The monies which many of Haughey,s associated hoovered up and lodged offshore long ago, still return to Ireland today on occasion, clean as new laundred sheets, to invest anew in fresh profitable activities and-yes you guessed it- the profits are still tax free.

(Industry sources have confirmed to the Irish Independent that document processing giant Xerox (Europe) has conducted a number of reviews of the Irish business over the past number of months.
These reviews have been looking at the possibility of outsourcing the call centre located at at Ballycoolin Industrial Estate in Blanchardstown and financial services jobs to cheaper economies such as India or Central Europe.
And the sources also confirmed that Xerox's manufacturing plant in Dundalk, Co Louth was also part of the recent review process.)

Dr Mark Harrold, from Malahide, worked for 13 years for St Michael's House, Ballymun, Dublin, a voluntary centre for people with learning difficulties.
Dr Harrold claimed at an Employment Appeals Tribunal that the reaction of St Michael's to him standing up for patient and staff rights was to "go after" him, and "undermine" him in what was "textbook workplace bullying".
St Michael's House denies the allegations, and contend that Dr Harrold only resigned after accepting another job with a health board, having been interviewed while his dispute with St Michael's was continuing.
Dr Harrold said he first raised issues about the care of patient Peter McKenna in 2001. St Michael's House will claim it did not have the facilities to properly care for Mr McKenna, who was 60, and had Down's Syndrome and Alzheimer's. He was moved to Leas Cross in September 2001 where he died two weeks later in painful circumstances from blood poisoning. !

Six hundred thousand names have been taken off the list as part of efforts to update it, but many of the deletions have turned out to be incorrect.!!
Environment Minister Dick Roche has described the removals as "inadvertent", but the Rabbites Party leader, Pat Rabbitte told the Dail that the whole situation was a mess.
"Third-world countries bring in the United Nations to see that their voting system is fair," he said.
"We're boasting about how wealthy a nation we are and we can't even compile the basic electoral register accurately.
"There are banks, finance houses, credit companies that have more accurate records."
Mr Ahern said that many of those who were removed were likely to be "hostile to the concept of a fairer stronger Ireland " and were "no loss anyway in the coming election",adding "we could definitely reprogramme those E-voting machines as well for a modest half million euros.. except for opposition party intransigence-a pity.!"

Figures released by "An Garda Síochána" 29th October 2006 show that 263 people have been arrested for drink driving offences over one bank holiday weekend alone.!
As part of the safety enforcement operation, gardai confirmed they had recorded 263 "suspected "drink driving incidents. Pray tell, What exactly is a "suspected drink driving case. Is it somebody who has failed the breathalyser test. Can we call a spade a spade- if it really is a spade.? This type of statistic is wheeled out every week after another weekend of carnage. Can we have more details please.? Do these hundreds of motorists join the logjam of thousands of similiar "suspect" cases detected by "An Gardai" in recent weeks, since Fianna Fail,s reluctant , and long awaited Damascus conversion to random breath testing; and their part time Publican/T.D,s "sea change " in attitude to drunken drivers.? Are those "suspects" now awaiting judicial proceedings.? Do we need a new "Regulator"(

A PROPOSED landfill threatens the production of a quarter of Ireland's fresh fruit and vegetables, protesters will claim next week.
The Environmental Protection Agency (EPA) has confirmed that it is examining the significance of a vast source of ground water in the north Fingal area.
The Tooman-Nevitt landfill, which would be one of the biggest in the State, is planned for a 500-acre site directly above the water source.
A Bord Bia staff member wrote a letter to the EPA expressing his concerns about building the landfill in an area "of intense horticultural production".
That letter was later withdrawn, with Bord Bia saying that planning was outside its remit, but the concerns will be raised by others at an oral hearing before An Bord Pleanala next Monday.
There are 27 objections to compulsory purchase orders relating to the landfill proposed by Fingal County Council, and 135 submissions in relation to the environmental impact.
"We have all the evidence we need, much of it coming from Fingal Co Co's own environmental impact study," resident Gemma Larkin said yesterday.
"There are 300 wells that are used daily from this water source, many of them by farmers to wash fruit and vegetables.
"To date, we have been able to collect factual information on 106 of these wells, which provide 35m litres of water each day. That's more than Fingal Co Co uses to supply Balbriggan. And we have evidence that this source could be polluted by the landfill," she said.
The Tooman site is close to the M1 motorway, about 11km north of Swords. It would have a dumping area of 137 acres, and a capacity for 9.4m tonnes of waste.
The council hopes that it will serve Dublin city and council for up to 30 years.
"We are aware of these groups' concerns and we would like to point out that we have completed a very detailed environmental impact study of the proposal," Gilbert Power, the council's director of services for environment, said.
"We'd like to reassure the public that there is no reason for concern. We are very satisfied that we can address these issues at the Bord Pleanala hearing and with the Environmental Protection Agency."
An EPA spokeswoman said that the application for the landfill licence remains under consideration, but could not give a date for a decision.
Bord Bia said that the letter to the EPA was written by a member of staff new to the job, and someone who did not know the group's remit.

The stockmarket values the asset. If shareholders are willing to sell at the offer price, then that is the real market value of Aer Lingus. If Mr Sharman can find an alternative suitor he can possibly extract more ‘value’ — but he has to find that suitor.

He declared: "If this continues I will seriously have to consider reining in the massive tax breaks which they have enjoyed under this government".
He is also considering outlawing current party policy of accepting large blank cheques from wealthy supporters . He continued "although there are no favours given or expected in return for generous donations,we are concerned about the impression it creates out there amongst a gullible electorate."
He announced that he himself is no longer taking personal whip arounds from Friends Of Fianna Fail as he now has a salary sufficient to keep him out of the poorhouse. Gracias a Dios.

A taxi union "Mafia" who have been disrupting service at Dublin airport; ripping off tourists with impunity for decades,and who represent less than 25% of Dublin,s taxidrivers are set to strengthen their monopoly of service at the Airport,by virtue of prohibitive annual charges by Aer Rianta for a permit to operate there.
At present only 25% of Dublins taxi operators are permitted to park there after dropping off a fare.
The new annual charges of 600 Euros per annum will create a "closed shop" for the Dublin Airport taxi Mafia.This has been their objective for the past 30 years.
Ger Deering the so called "taxi regulator" appointed by Fianna Fail (with a host of other ineffectual "regulators") has not addressed this most important of all the taxi issues. No doubt he will claim that the airport charges are none of his business because he has no authority in this matter.An unrepresentative minority of drivers who have hijacked the union and areclaiming to represent all taxidrivers has-as Ger Deering knows- won; game, set and, match.
The Airport taxi rank is now off limits to 75% of Dublins taxis.

Pat capitalizes on new stealth charges by Fianna Fail builders estate management rip off schemes.
In Spain for example all apartment complexes are legislated for by strict legislation governing the "community of owners" of any housing scheme.
They must have an annual general meeting yearly, and elect a President who is responsible for the debts and maintainance of the "community of owners".This is an entirely democratic process whereby the control of the apartment complex is governed by the owners-not by some opportunistic rip-off company set up by the builders of the scheme-as is the situation in Ireland today. Just one in seven new apartments are family-friendly and suitable for people to live in long-term. Most new apartments being built in the city centre only have one or two bedrooms, which means that homeowners who want to have a family will be forced to move out.
New figures released in 2006 show that just one-in-seven of all apartments given planning permission so far this year have more than two bedrooms.

The environmental group Friends of the Irish Environment have written to the European Commission alleging that the proposed 'up front fee' under the amendments to the Freedom of Information Act is an infringement of the Access to Information on the Environment Directive.
The 1992 Directive, which was implemented into Irish legislation in 1998,
'Guarantees any natural or legal person throughout the Community free access to available information on the environment in written, visual, aural, or data base form held by public authorities, concerning the state of the environment, activities or measures adversely affecting, or likely so to effect the environment, and those designed to protect it.'
A statement from the organisation released as the bill was debated for the first time in the Oireachtas said that 'While pubic authorities are permitted to charge for the actual supply of information, no fee can be charged for the making of a request'. Section 26 (6A)(b) of the Amended Act requires that 'a fee under this subsection shall be paid at the time of making of the request'.
The recent Reasoned Opinion from the Commission on our complaint on behalf of 67 community and environmental groups made it quite clear that the planning fee is illegal under European law and that Ireland was unique in the European community in charging for public participation in the planning process. Astonishingly, the proposed fee for receiving information has been inspired by this illegal fee. The Review Group Report notes: "The Group noted, for example, that a €20 fee accompanies planning appeals."
Both fees are unique in the European Community. The Access to Information on the Environment Directive states clearly that 'Disparities between laws in members states concerning access to the environment held by public authorities can create inequality'.
'The proposed fee for making a request is a further attempt by Ireland to circumvent the rights we hold as European citizens', the statement concluded.

Smaller carriers will however fit through and this happy prospect plus the proposed 800 million Euro buy out of the iniquitous "West Link toll bridge" will probably put enough lorries onto the M50, with sufficient rapidity, to ensure that the current logjam at the toll bridge will transfer to the Mad Cow roundabout where most of them will be exiting for The south of the country.
the Tailback from the Lucan road exit where lorries will exit for the west will probably block one of the three lanes on the Westlink bridge entirely right back past the soon-t- be-defunct toll plaza at peak periods.
The buy out of the Toll Bridge is a scandalous waste of money.The state will shortly, according to their original contract ,be benefitting from a revenue take of almost 100% of all extra vehicles on the M50.

The simple solution of sufficient booths, pre-paid, and electronic tolling, is being discarded .Every vehicle using the road could have an obligatory on line pre-paid account with NTR and the bridge could be opened tomorrow using scanning technology.
Instead 800 million euros is being paid to the NTR syndicate of wealthy farmers and big business just when the bridge is reaching its optimum benefit for the state. This is Martin Cullens greatest ever betrayal of the taxpayers of Ireland.
Every other country in Europe can operate an efficient toll plaza on a two or three lane highway-why not in Ireland.?
So much for 800 million in NTR,s pockets, plus a few billion for the Port Black Hole.This is a scam which none of the media or opposition parties have picked up on. It is of course possible that after the pay-off and after the election, three new toll booths may emerge along the length of the entire M-50,and ALL the revenue may accrue to the state.!!
There is either magnificent incompetence and waste in this buyout-or plain old corrupt cronyism.
The Soldiers of Destiny and Martin Cullen had another scheme to place three new tolls on the M-50 only 2 years ago which A spokesperson for the A.A. (Automobile Association) Mr Faughnan described as " madness".
Mr Faughnan,s analysis may be somewhat ingenuous.
Perhaps the "row" with the N.T.R (National Toll Roads). over the installation cost of a new electronic toll system at the Westlink tollbridge is nothing but a clever ruse to pay big taxpayers bucks to the toll bridge owners now and eventually bring a highly lucrative, multiply tolling system to the M-50 motorway which will cost sommuters dearly.? This has been an unforgotten objective in the minds of Fianna Fail Ministers for many years and was only postponed heretefore because of widespread indignation.
They have angered and antagonized many commuters with this proposed stealth tax, and it has been quietly dropped-for now. Paying off big business and removing the toll booths will do little but move the congestion to further exits a few miles down the road.
Will the host of harried motorists who are compelled to use any stretch of this chaotic public highway on a daily basis, give Waterford,s "Dick Turpin" and his cohorts among the "Soldiers of Destiny", their own quiet response, at the polling booths, in the coming General Election.

GARDAÍ are to be given new powers to crack down on rip-off pyramid schemes following an investigation into numerous multi million euro scams, which swept through much of the country.
The legislation, as part of a new Consumer Bill, has been unveiled by Enterprise Minister Micheál Martin , following a submission from the gardaí outlining their frustration in fighting the schemes, which swept through Cork, Kerry, Clare, Limerick, Meath and the west of Ireland, and even Dublin itself.
Large sums of money were invested in Telecom and Airline share flotations, offered as a get rich quick proposition, but the monies disappeared, into the conmens bank accounts, and the public were left with worthless paper.
The gang also amassed a fortune in monies through VAT, stealth and income tax scams. Instead of re-paying the money by providing proper health care and refuse services, it was used to finance golf courses and hotels owned by relatives of the tricksters. Some of it bankrolled an advertising, campaign which targeted foreign golfers.After being lured here, they in turn ,were mugged, in the hotels and golf clubs of the "Pyramid Mafia" .

Besides,Mansfields Meadow is the airstrip of choice for importing Cocaine & heroin into the state-how nice!

August 2006; A little early for Christmas ,but The Department of the Environment had the audacity to "announce" details of its payment of " more than €1.6m in grants for voluntary housing organisations this year".
The figure represents a miserable 4% increase on the "total" funding provided last year.
The largest beneficiary is the Irish Council for Social Housing, which has received an allocation of €410,000.
Threshold has received €350,000, while €195,000 is going to the National Association of Building Co-Operatives, €103,000 to Focus Ireland and the most deserving charity of all , the Simon Communities, a derisory €73,000!
All these organizations spend all their time and energy begging money from ordinary citizens,organizing sponsored walks etc. in order to fund their activities and provide a roof for the homeless, or trying to assist the poorest of the poor to purchase their own home.
And now a contrast: 1.6 billion almost down Bertie's "Black spending Hole".
A few years ago (2000), Dr. McDaid (Fianna Fail) gave details in parlimentary debateof the "estimated" cost of the development of Mr Ahern's proposed Sports Campus Ireland project, including Stadium Ireland, to be £550 million, to be funded from a combination of private and public sector money. "This estimate covers the cost of an 80,000 seat stadium, where the cost remains at £281 million as outlined in the feasibility study, including a private contribution of £50 million. The cost also covers the other elements that will be provided in Sports Campus Ireland, including an aquatic and leisure centre, a multi-purpose indoor arena, multi-purpose indoor training halls and pitches, a sports science and sports medicine centre, headquarters for sports organisations, a visitor centre and other sports facilities to be decided in consultation with the Irish Sports Council."
If the parsimonious P.D.s had not scotched Bertie's brainchild, it is more likely we would be on our way to spending 550 million euros x 3 ( normal multiple of Fianna Fail pre estimates) which comes in at 1.65 BILLION EUROS!
Bertie, if the Simon Communities could afford to, I have no doubt where they would tell you to stick your 73,000 euros.

Ireland has infringed EU waste directives in a structured fashion, in the opinion of the Advocate-General of the European Court,in September 2004.
It said the number of illegal dumping cases ``illustrated that waste treatment was not adequately controlled by the Irish authorities through the years''.
It added that the failure to comply with ``the core of the waste directive has been persistent, widespread and serious, so that there are serious grounds for establishing that Ireland has infringed the waste directive in a general and structured manner''. Although these private car parks are more expensive,and are fleecing the motorist for an extra hour's parking if you run 5 minutes over the 60 minutes. They are always packed to capacity, even when the street bays are almost empty due to the fear factor and the council's ruthless clampers.
Income from pay and display parking meters is a lucrative source of income for county councils - and coupled with parking fines have netted the four authorities more than €32m last year alone.
Dublin City Council gathers the most from motorists who insist on taking their cars into the city centre.
In 2005 the council took in €26m from pay and display machines and from permits for residents.

SF confident of winning 10 Dáil seats at next election :: latest (Examiner Sept.2006)
Sinn Féin's Pat Doherty has said the party is confident of doubling its Dáil representation at the next general election.
The party currently has five TDs, but speaking at its annual think-in ahead of the new Dáil term today, Mr Doherty said the party was confident of winning 10 seats next year.
Sinn Féin is fielding at least 41 candidates in the election, with more selections still to take place.
The party is unveiling many of these candidates to the media today at its gathering in Howth, Co Dublin, with a special website being launched to publicise their respective campaigns
It is also using the meeting to discuss strategy for the year ahead and tactics for the forthcoming election, as well as the latest developments in the peace process.
Speaking as the meeting got underway this morning, party president Gerry Adams said health would be one of the major issues when voters go to the polls.
He said there was widespread anger that the Government had failed to use Ireland's economic prosperity to fix problems in the health service.!! Where Mary has failed will Jerry triumph.? a few Armelites might resolve the problems in Irelands health "Angola".! Should we let Jerry loose among the consultants and bureaucrats of the H.S.A.?

The expected 50,000 fans, failed to turn up for the big screen presentation of a classic irish love story entitled; 'Show me the money-big fella!" Only about 1000 well heeled property developers braved the inclement weather, to see the show.
The hero of the film is not Eamon De Valera,as the title suggests, but a latter-day young soldier,named Cathal Haughey.The film charts the rise from poverty to plenty, of this handsomely brilliant young lawyer who was born in the slums of Donneycarney, a deprived working class ghetto in North Dublin. Conniving with a rag tag bunch of "cute Hoor",dissidents he and his power seeking pals, succeed in overthrowing the patrician "old guard" of the Fianna Fail political party,and assume control of the nation's destiny.
The self styled, " Soldiers of Destiny" proceed to the enjoyment of the spoils of high office, and together with their mistresses,they travel the world, living a jet set and champagne lifestyle, and generally running riot with the contributions of grateful property developers whose lands have been rezoned,while meanwhile inflicting cruel taxation and belt tightening upon the ordinary masses..
In a surprising twist to the story, a cunningly ambitious,power hungry, young soldier named Bertram,acclaimed for his uprightness in the face of temptation, is appointed treasurer,and charged with distributing the corrupting donations among the "Soldiers" of the governing junto and ensuring that Cathal gets the lion's share..
Ingeniously, Bertram manages to refrains from personal involvement in the cesspool of corruption by various subterfuges such as wearing dark glasses when present at cash distribution meetings with Cathal, and signing blank cheques etc.
His ambitions are finally realized,when his integrity is recognized by all the Cabinet, and after many years pass, these corrupt soldiers are striken with remorse, and elect Bertram-the only soldier who has not trousered bribes- to the highest office in the land: "An Taoiseach"
Good triumphs over evil and the only person in possession of "clean hands" is rewarded. (Bar the odd whiparound for 50,000Euros deposit on a new house)
He and his mistress, now enjoy the fruits of their patience, travelling the world and mixing with popes,presidents, royalty,gliterrati, etc,and live happily ever after. In their old age they retiring on modest index linked state pensions,open a cosmetic and beauty saloon, and watch soccer every day, while enjoying a few pints in their local pub.

The "Meath on Track" lobby group claimed that the "Transport 21" plan seems to be based on political expediency rather than merit.(Surprise.?)
In a statement the group said: "It seems ludicrous that the Western Rail Corridor (WRC) is being built ahead of the Navan Clonsilla railway line when it (the WRC) is expected to attract only 750 passengers per day.
The Navan Clonsilla rail link will have the capacity to carry 20,000 commuters each morning which is over 25 times the projected passenger numbers on the 234 kilometre Western Railway Corridor,and help Fianna Fail land speculators develop their holdings in the Navan area.
750 passengers a day being given preference ahead of the tens of thousands of Meath and Cavan commuters does not make any sense."
Projected passenger numbers on the WRC will only be enough to half-fill a single 8-car 29000 railcar set of the type which currently operates the Dublin Sligo line and which is designed to carry 1,500 passengers.
The railway project which has been dubbed "the biggest railway reopening in the State's history"!! by the Department of Transport will not see enough passengers per day even to fill a single Intercity train." You could not make this stuff up( for the coming elections) unless you had a neck like a Fianna Fail heifer.

And if you could get permission – which after the Government issued new Guidelines for Rural Development in 2004 was infinitely easier - you built anyway and then got permission to retain what you had done.!
Its stunning to see what this unsustainable policy has done to the countryside – and continues to do every day with record breaking construction levels. But its even more stunning to see how it has demonised the environmental movement."

Planning, whether local, regional or national, does not coexist harmoniously with our political system.
It seems the better the plan, the less likely it will be implemented.
The National Spatial Strategy (NSS) and the strategic planning guidelines (SPGs) for the Greater Dublin Area were drawn up to direct and coordinate a plethora of county plans, all aimed at furthering the interests of a small minority of financially-influential individuals in the business and property sectors in the hope of making short-term, locally-focused political and institutional gains.
In 2001,Tony McEvoy,an Independent Kildare County Councillor brought a High Court challenge to the newly-adopted Meath County Plan for its failure to have regard to the SPGs.
After a lengthy hearing, in which the chief author of the regional plan for the Greater Dublin Area gave evidence in his support, the court decided that the words ‘‘have regard to’’ were so devoid of meaning that any legislative measure based on them was a waste of effort.
The judge stated that the law should be reviewed, as this affected a number of important legal measures based on ministerial directives.
The NSS is one such measure.
In a lengthy interview given afterwards in a national daily paper, transport minister Martin Cullen stated that he "had no problems with the wording of the act". A group of Latvian and Lithuanian mushroom pickers were paid about €2.50 an hour, with no holidays or days off, not even Christmas Day, Siptu revealed .
The women claim they were let go immediately after they complained about new conditions imposed by the employer Kilnaleck Mushrooms in Co Cavan, and now face possible eviction from their home which is on the same farm.
Siptu spokeswoman Irene Donegan described the case as one of the worst she had ever come across and said that it appeared the employer had broken every single piece of labour legislation.
"It is an appalling story," she said. The women say they were forced to work between 80 and 100 hours per week for an average of €250.
The employer deducted €25 from that while they paid a further €50 in rent for the house which 10 of them shared.
Some of the 17 women have worked for Kilnaleck for up to three years. The women say they paid €500 to a recruitment agency in their own country for the job in Ireland.
They were told they would be paid at least the minimum wage of €7.65 an hour.
An investigation by the Department of Social Welfare into the women's status concluded they were effectively employees.
Ms Donegan said that decision should ensure that the employer is obligated to settle up with the Revenue.

CHILD benefit claims by EU workers in Ireland for families living abroad are set to hit €70m a year after applications quadrupled in the space of four months.
After a political row in January,2006 the number of claims per week rose from 80 to over 300 due to the publicity.
With each claim covering two children on average, by the end of this year the Department of Social and Family Affairs will have dealt with claims for around 30,000 children.
Under EU rules, parents living in one country can get the difference between the child benefit levels at home and those in their host nation, even if their families do not live with them.!

A LARGE group of Nigerian bogus asylum seekers were sent back home on a special flight out of Dublin in Sept 2006 - including several caught in a major social welfare fraud investigation.
The deportation followed a nationwide series of arrests by detectives from the Garda national immigration bureau over the past week.
More than 30 Nigerians were flown back to the capital, Lagos, on a Boeing 767 plane that had been chartered from a Dutch firm at a cost of €285,000.
The group included a number who had been arrested by gardai following a joint investigation with the PSNI and police in Britain into social welfare abuses by asylum claimants.
The investigation, which has been under way since the start of the year and is codenamed Operation Gull, netted large-scale fraudsters, including a Nigerian couple who were registered for benefits here but were also running a four-star hotel in Lagos.

AROUND 300 farmers attended a protest at Loughan House prison near Blacklion,Cavan in support of jailed north Sligo farmer Andy "Bull" McSharry.A more recent protest called in County Mayo to demand leniency for the farmer who shot a homeless father of eleven children in cold blood,who was wandering on his property, has been postponed.
Mr McSharry was arrested and jailed failing to pay a E300 fine imposed at Grange Court for threatening and abusive behaviour towards two hill walkers at his land at Gleniff .
At the protest, which was attended by Irish Farmers Association (IFA) national president John Dillon, a petition, containing over 2,000 signatures, supporting farmers’ rights to shoot vermin and trespassers, was handed in.
Mr McSharry was originally brought to Castlerea prison, where he was visited by Mr Dillon and some members of Sligo IFA.
Mr Dillon said he had spoken to Mr McSharry before about this issue and supported his right to shoot trespassers on sight.
Mr McSharry was later moved to Loughan House, where a protest was organised by the Irish Cattle and Sheep Farmers Association (ICSA).
ICSA Sligo county chairman Gabriel Gilmartin said the turnout, with people coming from as far away as Tipperary, showed the strength of farmer feeling on this issue.
He said the jailing of Mr McSharry was the unfortunate outcome of a situation that had got out of hand.He told reporters that the only stranger who could safely enter his land was the postman,delivering his monthly "set aside" decoupling cheque, issued by the E.E.U. Common Agricultural Fund. Meanwhile John Dillon has issued a "Fatwa" on the life of renegade politicians Tony Blair and Peter Mandelson.Both men have gone into hiding as concerns for their safety mount.

A STAGGERING 300,000 public order offences have been detected by gardai since a special crackdown was ordered on the streets four years ago.
The initiative, codenamed Operation Encounter, was launched after a soaring increase in street crime and growing public clamour for action.
The level of minor lawlessness at night has now begun to stabilise as a result of the operation and tougher legislation governing the sale of alcohol.
But the Government remains concerned at the huge total of offences and Justice Minister Michael McDowell has decided to allocate special fundingof €5m to the Garda authorities to expand theiractivities.
The minister last night told the Irish Independent: "The existing Operation Encounter has been an outstanding success for the Gardai, as can be gauged from the number of offences.

But what punishment lies in wait for peeing in the streets,Michael,or for murderous thugs who almost killed somebody,s child in Sligo?
A STUDENT was kicked unconscious by what a judge described as "a gang of bowsies" an hour after arriving in Sligo town to visit his cousin,in November 2004.
Aidan Walsh (21), a computer student from Clondalkin in Dublin, spent two days and two nights in hospital following the unprovoked attack, in which he received serious head and eye injuries and was left for dead on the street.
14 months later,in January 2006 at Sligo Circuit Court, Judge Anthony Kennedy handed down suspended jail sentences to three men for their involvement in the assault.
Robert Burnside (22), St John's Tce, who had pleaded guilty to four charges, including assaults on Aiden Walsh and his cousin Peter Kennedy, violent disorder and being drunk in public, was sentenced to one year on each of the assaults and on the violent disorder charge, which were suspended.?
He was also fined €100 for the drunk offence.
Raymond Farrell (22), Benbulben Tce, who had pleaded guilty to three charges, was sentenced to 18 months for the assault on Walsh and to one year on the violent disorder charge. Both were suspended ?.
David Cawley (21), Rathbraughan, was given a six month sentence by the court on a charge of violent disorder, which was suspended unconditionally. ?
Aidan Walsh had arrived in Sligo on the 8pm train on the night of November 19 2004 to visit his first cousin, Peter Kennedy, Ballintra, Co Donegal, who was a student in Sligo at the time.
Judge Kennedy said that the victim had been in the wrong place at the wrong time and became victim to "a gratuitous attack by a gang of bowsies". Well ,you can always phone Michael or Mary....if you live, to make that call.!
Remember, that but for the grace of God is your child-or mine.!
Meanwhile the Gardai are to take a front seat role in hastening the demise of the hated McDowellites during the next election.McDowell has struck back.The new reservists may be almost independent of the discredited force..

Under the latest figures released by the Department of Agriculture's central applications facility, 4,000 Dublin-based civil servants will not transfer with their jobs if the plan, originally due to end in December 2007, is completed.
Staff in the Department of Agriculture's offices in Davitt House, Castlebar, had been moved into overcrowded offices and left with little work to do because their functions had been transferred to Portlaoise, he claimed.
"The Castlebar staff would not move, contract workers were brought into Portlaoise in rented buildings and they brought in other livestock personnel from other regions and paid them overtime. "They have moved them down to the veterinary office, which is now overcrowded, which doesn't have the work for people. The thing is an utter shambles. Some people will be left sitting until they reach pension age, their experience and capability unused. If they continue the way that they are going, they will break the long memory of the public service."

In what may arguably be, the greatest financial disaster ever imposed upon the nation by any political party,(usually the same one!) the media have not entered this arena in a constructive and engaging way. There has been no useful debate on the lack of focus on costing the relocations, little, on the absence of a business case, little on the damage to quality of service and efficiencies already achieved through modernisation. Yes, some focus on people issues but little on the difference in conditions affecting civil and public servants. Also little on the role of Department of Finance officials, in particular, in a blatantly political agenda which could be as big a millstone on the taxpayer as the abolition of rates in the 1977 Great Promises Election. These are the same good people who brought us governance, fiscal rectitude and value for money principles. It is perhaps the greates case of attempted gerrymandering of the voting register,ever conceived.the cost,when it all unravels,will be enormous in many ways-not only within the financial spectrum of increased taxation.
David Went, CEO of Irish Life & Permanent, stated that to obtain a salary-indexed pension (like our public servants have) in the private sector would require contributions of 45% of a person's salary throughout their working life! Public servants pay around 6% of salary for their pensions.
He also stated that when consequent pension costs are included, the true cost of the last benchmarking deal was €20 billion and not €1.1 billion as is often stated.

THE Government is set to rake in more than €1.5 billion from taxes on unleaded petrol this year as it benefits from higher prices at the pump. The Government takes a flat 44.3 cent in excise duties from every litre of unleaded sold. But it also levies VAT of 21%, meaning that, as prices rise, so does the Government’s intake. The most recent figures from the Central Statistics Office show that, in February, the average price per litre of unleaded petrol was 108.2 cent.
Of that, the Government was receiving 44.3 cent in excise and 18.78 cent in VAT,
giving it a total of 63.05 cents-and rising daily- from every litre sold.
Provisional figures from the Revenue Commissioners show that the Government pulled in just over €395 million in total from excise and VAT on unleaded in the first quarter of the year. The quarter began on December 20, in line with standard accounting practice for revenue returns.
If prices remain high and current sale trends continue, the Government will have taken €1.58bn in taxes on unleaded by the end of the year — €1.138bn in excise and €443m in VAT.
Last year, unleaded petrol earned €1.37bn for the Government (around €1bn in excise and €368m in VAT), while in 2004, the total was €1.3bn (€970.7m in excise and €328m in VAT).
The average price for a litre of unleaded petrol last year was 109.4 cent, an increase of 8.5% on 2004’s figure of 100.8 cent.
Last year, the Government took 63.25 cent from every litre sold, an increase of 2.4% on 2004, when it took 61.76 cent.
The Automobile Association has urged the Government to lower VAT or the excise duty to ease the burden on motorists. According to the organisation’s latest price survey, the cost of unleaded per litre was running at 110.6 cent last month. Reduce taxes.?-("Over Bertie's dead body."!)

A spokesperson for the A.A. (Automobile Association) described Mr Martin Cullen,s latest toll plans as" madness".Mr Faughnan,s analysis may be somewhat ingenuous.
The "row" with the N.T.R (National Toll Roads). over the installation cost of a new electronic toll system at the Westlink tollbridge is nothing but a clever ruse to bring a highly lucrative, multiply tolling system to the M-50 motorway which willl net many hundreds of thousands of extra contributors.This has been an unforgotten objective in the minds of Fianna Fail Ministers for many years and was only postponed heretefore because of widespread indignation.
It is remarkable that despite angering and antagonizing so many commuters with this latest stealth tax, which will do little but move the congestion to further exits a few miles down the road, they feel supremely confident of their re-election prospects.
Will the host of harried motorists who are compelled to use any stretch of this public highway on a daily basis, will give Waterford,s "Dick Turpin" and his cohorts among the "Soldiers of Destiny", their own quiet response, at the polling booths, in the coming General Election.?

Today a number of new amendments specifically targeting errant "Soldiers of Destiny" like Martin Cullen, have been added to the current Fianna Fail list of 69 odd driving offences,listed on the new Road Traffic Bill-all of which attract penalty points,should the computerized system which compiles such records ever swing into action. Mr Ahern, has announced that ministers who violate them will then be punished. A severe "rap on the knuckles" awaits wrongdoers," nobody is above the law, in Fianna Fail" said Bertie.

THE Dublin businessman whose hotel was drawn into an investigation into IRA money laundering is facinga demand of an estimated €2m in unpaid taxes from the Criminal Assets Bureau (CAB).
Businessman Patrick Leneghan, who put his Earl of Kildare hotel on the market last week for €17m, was served with the tax assessments before Christmas.
The businessman, who owns a number of pubs, was exposed to enormous public scrutiny last year when his popular city centre hotel was raided by the Criminal Assets Bureau.
Detectives investigating suspected IRA money laundering conducted simultaneous raids on a number of premises. The raids on Mr Leneghan's hotel attracted even greater attention when it emerged that a number of politicians, amongst them the Minister for Defence, Willie O'Dea, had to be evacuated from the building.
The hotel, situated in Kildare Street and close to Dail Eireann, is a popular haunt of politicians. 
Mr Leneghan later confirmed that he was the target of the money-laundering investigation, in a statement issued through his solicitors.
But he dismissed as nonsense claims that IRA cash was laundered through his businesses.
He also claimed that the allegations damaged his business and that the leaking ofinformation against him was motivated by "wider political and commercial concerns".
The Garda investigation resulted in Mr Leneghan's business affairs being scrutinised by detectives and sources confirmed last week that an assessment believed to be in the region of €2m was served on Mr Leneghan for unpaid taxes dating back several years.
Mr Leneghan owns two other bars in Kildare and in south Dublin.
Gardai launched Operation Phoenix to trace the proceeds of the €38m Northern Bank raid and arising from this the Criminal Assets Bureau began investigating businesses which they suspected had laundered cash for the IRA.
Mr Leneghan's hotel is now likely to be redeveloped as offices and apartments by its new owners.
Located on a valuable city centre site the hotel is ex-pected to attract huge interest from speculators and developers.

The Courts Service has announced that it will now enter into detailed negotiations with Babcock and Brown to conclude a contract on what it described as a "landmark project".
A 22-courtroom complex on a site at Parkgate Street and Infirmary Road will be built in a public private partnership arrangement.
The Courts Service said the complex will be a state-of-the-art criminal justice facility "suited to the administration of criminal justice in twenty first century Ireland". ( justice,for whom?)
All central Dublin criminal business will be conducted on the new site. Existing courts and administrative offices from the District, Circuit and Central courts will be transferred to the new facility.
It added that the facility will result in a much-improved service to the public, witnesses, jurors, judiciary, professionals and staff.
"The Courts Service will deliver this facility by means of a Public Private Partnership. It believes that this method of delivery presents an opportunity to leverage private sector innovation, ensuring quick and efficient delivery and so deliver best value for taxpayers."
( the word "leverage" is a wonderful euphemism. Soldiers of Destiny doublespeak for a way of saying that the irish taxpayer will pay -and pay dearly-for this new building, over the next 30 years.In effect bertie is taking out a 30 year mortgage with Babcock & Brown.! He has announced it,but how many among his electorate comprehend the subtle meaning of the word "leverage"?

THE news that a luxury hotel has opened at Fota in Cork harbour has stirred recollections of that beautifully wooded island estate and what has come to pass there.
In the mid 1970s, a Mrs Bell (nee Smith-Barry), who owned the island, essentially gave the 780-acre Fota estate to the people of Cork.
While she sold it to UCC for a nominal sum, I believe it is more correct to say she gave it to Cork’s foremost public institution and that her intention in doing so was to ensure that her lovely estate would become a public resource in perpetuity.
The circumstances in which the greater part of that public resource pretty swiftly came once again to be in private ownership are still largely unknown to the public because of the passage of time and the quite normal secrecy of those involved in entirely legal transactions. Since then the ‘development’ of Fota has gone on apace — first one golf course, then another, and now the hotel. There is also a website advertising many ‘exclusive’ golfing lodge-style houses. The irony of marketing Fota on the basis of exclusivity, when so brave and generous an attempt had been made to render the entire island a green and wooded oasis of public inclusivity, is evidently lost on the developers and their copywriters.
I daresay that future generations of Corkonians will feel more keenly than we do for what has been lost. They will inhabit an environment even more built up than ours. For them an island of 780 acres set aside as a public nature reserve of old-growth deciduous woodland would have seemed like a jewel dropped from Heaven into Cork harbour. But we are left to contemplate only what is and what might have been.
editors note: During the McSharry (Fianna Fail government) cutbacks, in the late 1980s, when so many hospitals, etc. were closed, UCC, like many such institutions, was forced to sell some of its assets, principally part of Fota estate.

Public Bodies have developed in an ad hoc manner. There are now over 450 of them. A coherent and joined up rationale for the establishment of Public Bodies is an imperative. In their latest research launched in May 2006, the authors Paula Clancy and Grainne Murphy look to untangle the 'fog index' that exists around how the Government works.
Many Public Bodies are not covered by the different measures to provide transparency and accountability such as the Freedom of Information legislation.
More than 5000 appointments at national level alone are estimated to be in the gift of Government with no clearly established mechanism to ensure that appointments are free from undue political or other influence.
Speaking about the research Paula Clancy, Director of TASC and author of the report said that
"Unplanned and ad hoc mushrooming of Public Bodies combined with the lack of good information about them is bad for democracy. This is particularly since their numbers have grown very markedly in the last ten years and many are hugely significant in their impact on people's everyday lives. The fragmented manner in which they have grown adds a further layer to the bureaucracy of government, constraining an individual citizen's ability to interact with an agency from which they are seeking a public service".

The Mahon/Flood tribunal is now gunning for his immediate associates, life long friends, namely one Tim Collins- part of the so called "Drumcondra Mafia",party fundraiser,and trustee of Fianna Fail's command centre "St Lukes" in Drumcondra.
Collins and Ahern are extremely close and Tim was present on many occasions in the past when Bertie met important investors intent on doing business in the field of "property development"
One such individual Tom Gilmartin remembered his presence-but not his name- when he met Bertie in 1988. Tom,an outsider and blow in from John Bull's country, was truly "shafted"(to use Bertie's recent terminology) by the Fianna Fail property Mafia shortly afterwards and it will be remembered that he vented his spleen in the Tribunal after "Pee" Flynn (of trousered cheques fame) made disparaging remarks about the poor man on R.T.E.
The circumstances in which Tim made a killing of 700,000 euros when he in partnership with the McCann (Fyffes) family were the beneficial owners of a company called "Deepriver Ltd" which purchased land on the site of the "Battle of the Boyne" for 3.4 million euros and sold it on a few weeks later to the state for 9.4 million euros.
The reason this er, stroke of fortune happened was that at the same time as they were buying the land by an incredible coincidence,Bertie was minded to create a memorial park to King William of Orange in honour of his glorious protestant victory over the papist forces here, some centuries past.
When Judge Alan Mahon questioned Tim Collins initially, poor Tim had forgotten completely about the deal, (so much Alzheimers among the old soldiers of destiny nowadays) a lapse of memory which the judge described as "extraordinary" and "astonishing" and said that poor Tim's recollection was vague and poor "to a greater extent even than we might be used to".This is some distinction to bestow on a witness before a tribunal that has jailed Liam Lawlor for his obfuscation.!
In the last three months Collins has figured in three different deals being investigated by the Mahon Tribunal and his evidence has been shot through with inconsistencies.
Te tribunal is now scrutinizing Collins bank accounts to try and shed more light on his wheelings and dealings with other august tribunal guests such as Frank Dunlop,Liam Lawlor,G.V. Wright and others..
Bertie Ahern had no direct dealings with any of the land transactions under enquiry,but dont turn over any stones if you walk through the rose garden in St Lukes.You don't know what-or whom- you may find underneath..
