Criminals will still evade Justice.

The Fianna Fail Justice Minister's rejection this week of the Fine Gael Bill, which aims to deal with the admissibility of evidence in criminal trials, despite having made a commitment in the Programme for Government to legislate in this area, is evidence of his political vanity and unwillingness to deal with Ireland's spiralling crime rate.

The Bill which was introduced by the Fine Gael Seanad Justice Spokesperson, Senator Eugene Regan, provides for the abolition of what is known as the "Exclusionary Rule" which sees evidence from criminal trials, which may have been obtained by some improper means such as by chance or due to a minor clerical error, not being admitted in court. This results in cases being thrown out of court on what is essentially a 'technicality'.
"The Bill would have allowed judges, in deciding whether to admit such evidence, to balance the rights of the accused, the rights of the victims of crime, the public interest in the prosecution of crime and public confidence in the administration of justice.

It is understandable that Fianna Fail have no desire to see numerous criminals sentenced to jail terms-there are no places for them in the overcrowded Victorian prisons anyway!

Identifying the people not registered with Revenue.!

Although a banking report last year estimated there were 33,000 millionaires, the Revenue Commissioners are only able to identify 12,300 people with incomes over €250,000.

Maybe ask some of our prominent TDs where they are still hiding? Maybe start with her "fancy builder man".? First we need a database of every able bodied citizen actually living in the country and running any kind of business.(Many of them may not even have PRSI numbers..)

Then we need a team of extraordinary Revenue "head hunters" equipped with powers to doorstep every likely looking farmer/builder they encounter and demand identification.They would then have full power to prize open all bank accounts held by the individual on a pure random basis.

There should be no need for the Revenue to have any suspicion. An ideal scenario would be a traffic checkpoint manned by Revenue officials.Every driver of a vehicle costing over 50,000 euros could be randomly investigated and checked for tax compliance.

Lets say for example a nosy neighbour see somebody like Liam Lawlor (now deceased), burning files in his back garden and phones the Gardai. The report is immediately referred to the Revenue posse who would have a rapid reaction team with powers to begin the fullest investigation of all his activities,assets etc.

Such a new force could number many thousands, and numerous idle civil servants from other departments might be seconded to the teams.

A story: I retired from commercial activity some ten years past, and moved abroad. Due to a small clerical blip in the process of closing down my business this fact was not correctly registered with Revenue.

Annual tax forms continued to arrive at my former home in Dublin, every year afterwards for about 5 years .

After another three years passed , with no completed forms getting back to Revenue,a letter arrived threatening prosecution if I did not finally send in my tax returns for the previous 8 years.!

A worried family member returned the letter with the news that I had emigrated some ten years previously.

No word since. My point is, at this rate of activity, most of the "missing" 33,000 millionaires may well be with CJH and Liam and the rest of the Hoodlums of Destiny, in their graves, before they ever even get a letter (or an Email ?) from Revenue!-and their is no mail delivery (not even a computer) where they-and thousands of their pals -are languishing at present!

A report in the Irish Independent (19th November 2009) suggests that the finance minister Brian Lenehan will meet senior bank management today to discuss the position, 'as a number of private equity firms circle the banking system looking to co-invest with the government'. The report mentions Carlyle and JC Flowers along with Sandler O'Neill, which it suggests is advising an interested consortium. Meanwhile, an article in the Irish Times quotes the Minister for Finance saying 'informal approaches' have been made by several potential investors.

An Irish-led consortium of private investment firms is reportedly prepared to invest €7-8bn in a merged group of Bank of Ireland and Irish Life and Permanent, with a significant stake in Anglo Irish Bank as part of the package.

The consortium is believed to be able to lend up to €60bn to small businesses over five years. I wonder who that "Irish -led consortium" really are.?

TAOISEACH Brian Cowen recently predicted that unemployment could reach over 300,000 next year.

As the numbers joining dole queues yesterday surged to over 250,000 for the first time in 11 years, Mr Cowen said in a 'Hotpress' interview that unemployment could rise by "over 70,000, at least" for next year, pushing unemployment as high as 320,000.

FORMER Taoiseach Bertie Ahern was targeted last night and an attempt made to set his state car on fire in Dublin city centre.

Witnesses said a flaming bag was thrown at the government Mercedes car, parked on South King Street, just after 8pm.

According to witnesses, flames shot up the side of the car causing extensive damage to the underneath and rear left wing of the '06 Mercedes.

A large crowd of unemployed young men were noted fleeing the scene in the company of old age pensioners; recently retired pensioners; bank shareholders, a host of sick and handicapped people ; MRSA victims; Cryptosporidium riddled Galwegians; Cancer patients;and many others who have now lost pretty much everything because of his botched tenure in office..

Many of the assailants had apparently been in the area peacefully Christmas shopping at the time. The attack was thought to be entirely opportunistic, and not part of a conspiracy to "Moyross" the discredited politician.

Rumours had earlier swept through Grafton Street that Mr Ahern -who had recently been disabled by a fall from power-was attending a book signing function in a wheel chair and was thereby in a highly vulnerable position .

The Gardai condemned the incident as "a cowardly and dastardly attack on a helpless politician".

Coillte-the quango that plants conifers on bogs, pollutes the waterways, and destroys scenic lakeside forests for a song.

Coillte has defended its decision to fell part of one of the last woodlands on the shores of Connemara's Lough Corrib. The forestry company has been licensed to remove 440 trees from Annagh wood, location of a children's cemetery and public right of way. The European Court of Auditors and the European Commission are wondering what the Rural Environment Protection Scheme (REPS) and other agri-environmental measures are delivering in terms of value for money.

Agriculture Minister Brendan Smith told the Teagasc REPS conference in Tullamore, Co Offaly, in November 2008 that this was hardly surprising, when one considered the huge amounts of money being put into these schemes.

Mr Smith said since REPS began in 1994, Irish and European taxpayers between them, have paid more than €2 billion to farmers.

“I myself have no doubt that REPS has delivered much to the community as a whole, in terms of water quality, biodiversity and landscape", he said.

Mr Smith said this year REPS has been the subject of searching audits by both the Court of Auditors and the Commission.

“We are still finalising our responses to their comments, but Europe’s emphasis on tighter and more robust verification of outcomes is coming across strongly. We have to deliver on this,” he said.

Michael O’Donovan, principal officer with the Department of Agriculture, said he was concerned about the outcome of an audit by the Court of Auditors and the Commission into the operation of REPS on Irish farms.

Last time I had a query for an issue with the Social Welfare Department, I spoke to an old Biddy on the phone who told me to put my question in writing and send it in to her and it would be addressed and responded to-eventually.

I did all this and when I had forgotten about the whole matter six months later a letter arrives in my post box from- guess who-the old Biddy I had been speaking with.! .I could have been dead.!

So much for the age of the computer-or maybe Social Welfare have special instructions to maintain snail mail, it probably saves them a fortune in various payments when the claimants have passed away by the time their problems are addressed.! More funny s*it here:

McNamaras debts &Hard Times for the old lags.!

While the Health Executive is currently recruiting more 100,000 Euros per annum executives to manage Mary Hearneys increasingly unmanageable Health Service and closing down beds in Hospices for the dying such as Our Ladys in Harolds Cross- some of the Fianna Fail governments Public Private Partnership scams are unhappily unraveling in these recessionary times.

The consortium selected to build the Thornton Hall super-prison is led by one of Fianna Fails darling developers-the one and only Bernard McNamara from Cahersleeven, in the County of Kerry.

Mr McNamara recently pulled the plug on another similar PPP scheme to build luxury penthouse apartments on a choice city centre site (Currently a near derelict, tenament style development of Fianna Fail. One of their yesteryear panaceas to Dublin´s housing problems."O Devaney Gardens", near Dublins famous Phoenix Park.

The public owned site was to be provided totally free of charge by the Soldiers of Destiny-providing a number of free? apartments for poorer Dublin families were included in the mix of mostly luxury penthouse dwellings.! This project was abandoned despite contracts signed by city councilors, on behalf of the nation, and the "Darling Developer" McNamara.!

Mr McNamara is now set to abandoned the new super jail project at Thornton Hall in the County of Dublin, as the banks are a mite short of cash to finance the developer..( 400 million euros short, in fact).

The living quarters of the current occupants of Mountjoy Jail-originally built during the Victorian Era as a House of Correction for thieves and murderers of a previous century- are without many of the basic comforts we citizens take for granted nowadays (such as a toilet).

It looks like these wretches will be living with the stink of their own excreta for the foreseeable future, due to the collapse of the Capitalist World, as we know it.

McNamara has banking relationships with several lenders, including AIB, Bank of Ireland, Anglo Irish Bank and Bank of Scotland (Ireland). While the exact extent of his total borrowings is not known, it stretches into the hundreds of millions of euro.

Tut-tut,those greedy bankers have caused more mayhem and misery than they will ever know.!

Property developers putting assets in their wives' names

property developers have begun moving their houses into their wives' names as fears grow that banks will move against their assets.

Sources also said several developers were looking to move assets that did not have mortgage charges into trusts, with their wives and immediate families as beneficiaries, as they seek to limit their exposure to personal guarantees they made when borrowing money.

In 1995, Mr Justice Richard Johnson ruled that the purpose of the 1976 Family Home Protection Act was to protect the family home and "to prevent families being evicted when a spouse, through either stupidity or greed or whatever else – or bad business or bad luck – lost the family home".
Some developers hope that means they will not lose their homes when they go bankrupt.
Given the value of many of the houses and their location, the developers could later sell the house to raise the equity to go back into business.
Legal, accountancy and investment sources have confirmed that the moves have been under way for months.
"I have no doubt it's being done," said one senior tax adviser.
However, one legal source warned that it would be hard for the trust moves to stand up in court.
"That would be a fairly well-used trick. It is easily undone and the court will just void those transactions," he said.
Meanwhile, some banks are believed to be taking their property loans off their balance sheets and moving them to their trading books so that they will not have to write down their values. Instead, the loans could be amortised over several years.
